Introduction

These Terms and Conditions ("Terms") are designed to ensure a safe, respectful, and transparent experience for all users of our mobile application and website (collectively, the "Platform"). The Platform is operated by Bell Bang Enterprise (referred to as "we," "our," or "us"). By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines (collectively, the "Platform Policies"). If you do not agree with any of these policies, you must not use the Platform.

1. About the Platform and Our Services

The Chunkz Platform facilitates one-on-one audio and video calls between users. These interactions are entirely voluntary and initiated at your discretion. We also provide the option to purchase and use virtual items, such as coins and gifts, within the Platform.

By using our services, you enter into a legally binding agreement with us. We act solely as an intermediary platform under applicable Indian law and do not control, endorse, or assume responsibility for the content or conduct of any users or the quality of user-to-user interactions.

2. Eligibility

To use the Platform, you must be at least 18 years old and legally capable of entering into binding contracts. By using the Platform, you confirm you meet these requirements and will comply with all applicable laws in your jurisdiction.

3. Your Account and Registration

To access our services, you must register an account with accurate and current information including your username, mobile number, gender, and age. You agree to keep your account details secure and confidential.

You are solely responsible for all activities under your account. Do not share your account details, including OTPs or login credentials, with others. If you suspect unauthorized use of your account, notify us immediately at hello@chunkz.in.

By registering, you consent to receive communications from us, including promotional messages, on your registered mobile number even if it is on a DND/NCPR list. You also authorize us to share your information with affiliates or authorized service agents.

4. User Obligations and Prohibited Conduct

You agree to use the Platform lawfully, respectfully, and responsibly. You must not:

• Engage in any illegal, unlawful, or prohibited activities either on or off the Platform, including but not limited to harassment, threats, or solicitation.
• Share or request any personal information from other users, including but not limited to phone numbers, addresses, emails, social media accounts, or financial details.
• Engage in any sexual content, solicitation, or conduct including inappropriate, explicit, or sexually suggestive behavior or language.
• Upload, share, or post any content that is harmful, obscene, discriminatory, violent, hateful, or violates any intellectual property rights.
• Attempt to bypass or interfere with the Platform’s security features or systems, or use automated tools or scripts.

Violation of these rules may result in immediate suspension or termination of your account and possible legal action.

5. Account Suspension, Blocking, or Deletion

We reserve the right to suspend, block, or permanently delete your account at our sole discretion for any reason, including but not limited to:

• Prolonged inactivity.
• Violation of these Terms, Privacy Policy, or Community Guidelines.
• Requests or directives from legal or regulatory authorities.

We may act without prior notice if necessary to comply with law or protect the safety, rights, or security of the Platform or users.

6. Payments, Virtual Items, and Refunds

The Platform offers virtual coins ("Coins") and gifts that may be purchased via authorized third-party payment providers.

• Coins and virtual gifts have no real-world monetary value and cannot be exchanged, transferred, or redeemed for cash.
• All purchases are final and non-refundable except as required by law.
• Prices and terms for Coins may change at our discretion to prevent fraud or misuse.

7. Intellectual Property

You retain ownership of content you create, but grant us a worldwide, royalty-free license to use your content to provide and promote our services.

All intellectual property rights related to the Platform, including branding and software, belong to us and are protected by law.

8. Disclaimer and Limitation of Liability

We provide the Platform "as is" and do not guarantee its availability, accuracy, or security.

User Conduct and Off-Platform Activities: You acknowledge and agree that we do not monitor or control user behavior, whether on or off the Platform, and are not responsible or liable for any actions, communications, or damages caused by users outside the Platform.

You agree that you use the Platform at your own risk. We expressly disclaim liability for any direct, indirect, incidental, consequential, or special damages arising from your use of the Platform or interactions with other users.

9. Indemnity

You agree to indemnify, defend, and hold us harmless from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Platform.
• Your breach of these Terms or any applicable law.
• Your unlawful or unauthorized conduct.

This indemnity obligation survives termination of these Terms.

10. Termination

These Terms remain effective until terminated by either party. We may suspend or terminate your account immediately if you violate these Terms or engage in unlawful or harmful conduct.

Upon termination, your access to the Platform will cease and your data may be deleted as described in our Privacy Policy.

11. Dispute Resolution and Governing Law

These Terms are governed by Indian law. Any disputes arising shall be subject to the exclusive jurisdiction of courts located in India.
